These Terms of Service ("Terms") govern your access to and use of the Pulse59 mobile application and related services (collectively, the "Service"), operated by Pulse59 ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
You must be at least 13 years old to use Pulse59. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@pulse59.golf if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from unauthorized use of your account.
Pulse59 offers the following paid subscription tiers:
All subscriptions are processed through Apple's In-App Purchase system. By subscribing, you agree to Apple's payment terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription at any time through your Apple ID account settings.
We do not issue refunds for partial billing periods. All refund requests are handled by Apple in accordance with their refund policy.
We may offer a free trial period for new users. At the end of the trial, your account will require a paid subscription to continue accessing premium features. We reserve the right to modify or discontinue trial offers at any time.

You retain ownership of all golf performance data, health data, and other content you submit to Pulse59. By using the Service, you grant us a limited license to store, process, and use your data solely to provide the Service to you. We do not claim ownership of your data. Pulse59 is a performance tracking and insights tool, not a medical device or healthcare service. The Golf Readiness Score (GRS), health correlations, and all other insights provided by the Service are for informational and performance purposes only. They are not intended to diagnose, treat, cure, or prevent any medical condition. Always consult a qualified healthcare professional before making decisions based on health-related information.
The Service integrates with third-party platforms including WHOOP and Apple Health. Your use of those platforms is governed by their respective terms of service and privacy policies. We are not responsible for the practices or content of any third-party services.
The Pulse59 name, logo, app design, Golf Readiness Score methodology, and all related content are owned by Pulse59 and protected by applicable intellectual property laws. You may not use, reproduce, or distribute any part of the Service without our prior written consent.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or usefulness of any insights or data provided by the Service.
To the fullest extent permitted by applicable law, Pulse59 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
We reserve the right to suspend or terminate your account at any time if you violate these Terms or if we discontinue the Service. You may delete your account at any time by contacting us at hello@pulse59.golf. Upon termination, your right to use the Service ceases immediately.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice in the app before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Arizona.
